Statutory Summary Suspensions

Suspension Periods

Statutory summary suspensions are often administered after an arrest for driving under the influence of alcohol (DUI). Suspension periods are determined by whether you submitted to a breath test after a DUI stop and whether you have prior offenses.

  • First offense, submitted to breath test: drivers’ license suspension period is three months
  • First offense, refused breath test: drivers’ license suspension period is six months
  • Second offense, submitted to breath test: drivers’ license suspension period is one year
  • Second offense, refused breath test: drivers’ license suspension period is three years

Changes to Statutory Summary Suspension Laws

As of January 1, 2009, a Judicial Driving Permit is no longer available. As result, you will not be eligible to receive a driving permit for work, school or other commitments.
